demurrer:

1. One that demurs; an objector.

2. An objection.

3. Law A method of objecting that admits the facts of the opponent's argument but denies that they sustain the pleading based upon them.

"For all these reasons we conclude that the trial court properly sustained the demurrers to
plaintiff's complaint."

Before Nicholson appealed the case the first judge he sought out demurred the case.
